Child Support

When any matter including dissolution relates to the future support of children, it is important to have an attorney who can represent you in every step of the way.

Guidelines:
1. In Florida, it is public policy, as well as specified in Chapter 61 of the Florida Statutes, that each parent has a fundamental obligation to support his or her minor legally dependent child.

2. The amount of child support to be paid will be based on a formula already set by the State. The schedule will be based on the parent's combined net income and the number of dependents (other children). This amount may be changed if a number of factors are present, which can be applied to different types of situation. I will go over your case and will determine whether a variation could be requested by the trier of fact.

3. Gross Income, includes but not limited to:

b. Bonuses, Commissions, Tips, etc.
c. Disability Benefits
d. Worker's Compensation
e. Reemployment Assistance
f. Pension, retirement, or annuity payments
g. Social Security Benefits
h. Spousal Support
i. Interest and dividends
j. Rental Income
k. Income from trusts and estates
l. Reimbursed Expenses
m. Gains from dealing property

Mediation:


The court may refer the parties to mediation in any proceeding where one of the parties is contesting parental responsibility, primary residence of the child, access to visitation, and/or child support.


If an agreement is made, a consent order will be prepared by the mediator and the submitted to the parties for review. Once the agreement is made, the court will review the agreement and, if approved, enter an order for its enforcement.
